Dutch Gaming Authority tightens grip on gambling ads

The Dutch Gaming Authority (KSA) has issued a warning to an unnamed online gambling licensee for breaching the country’s strict rules on non-targeted advertising. The violation involved a television commercial featuring a football player wearing a T-shirt with the gambling operator’s logo.

Under Dutch law, non-targeted advertising for online gambling has been prohibited since July 2023. This ban was expanded to include programme and event sponsorship on 1 July 2024. The regulations aim to protect vulnerable groups, such as young people and those with gambling addictions, from exposure to gambling promotions.

While the promotional content did not directly advertise the gambling operator’s services, the KSA declared that operators are responsible for all representations of their brand, even those by third parties through sponsorship agreements. The regulator also stressed the importance of a clear connection between the gambling brand, the sport, and the location where it is practised.

Despite the violation, the KSA opted for a warning following the operator’s prompt response to prevent a recurrence. However, the regulator has reiterated its commitment to enforcing the advertising restrictions and protecting consumers.

Safeguarding online gambling customers

In more related news this week, KSA officially launched its new Online Duty of Care department. The unit, formed in response to concerns over online gambling operators’ adherence to customer protection regulations, will focus on enhancing safeguards and preventing problem gambling.

The decision to establish the department follows an investigation last September that identified discrepancies among operators in interpreting duty of care rules. The KSA found shortcomings in compliance with the Netherlands’ Remote Gambling Act (KOA).

Based on control data and player feedback, the new unit will conduct in-depth reviews of operators, particularly those with potential problem areas. It will also closely monitor the implementation of new duty of care regulations and investigate other red flags associated with gambling addiction.
