Former Spanish FA President receives three-year ban

Former Spanish Football Association (FA) president, Luis Rubiales, has been issued a three-year ban from all football-related activities by the global governing body, Fifa.

The disciplinary action comes as a consequence of a contentious post-match incident that unfolded after Spain’s victory in the Women’s World Cup final against England. During the trophy presentation, Rubiales kissed forward Jenni Hermoso on the lips, a gesture that sparked considerable debate and controversy.

Fifa’s disciplinary action following controversial post-match incident

Despite initially resisting calls to resign, Rubiales eventually stepped down from his position in September.

On Monday, Fifa officially announced the three-year ban, citing a breach of article 13 of their disciplinary code. This article pertains to appropriate conduct and behaviour during football-related events, emphasizing the need to maintain decorum and respect.

The controversy surrounding the kiss revolved around contrasting accounts of its nature. Rubiales claimed it was a “mutual” and “consensual” expression of celebration, while Hermoso asserted that the kiss was non-consensual, leading her to file a legal complaint.

Fifa confirmed that the case specifically related to the “events that occurred during the final of the Fifa Women’s World Cup on 20 August 2023, for which Mr. Rubiales had been provisionally suspended for an initial period of 90 days.”

While Fifa has allowed a ten-day window for Rubiales to request a motivated decision, his options include pursuing an appeal before the Fifa appeal committee. The global governing body emphasized its unwavering commitment to respecting and safeguarding the integrity of all individuals, ensuring that the fundamental principles of decency and respect are upheld within the world of football.

Background

Luis Rubiales’ tenure as the president of the Spanish FA was marked by significant controversies and events. The Women’s World Cup final kiss incident further added to the spotlight on his leadership. Rubiales had faced immense pressure to step down during the aftermath of the incident, and the eventual decision to resign did not quell the debate surrounding the appropriateness of his actions.

The Fifa ban indicates the importance of maintaining the highest standards of conduct within the sport and the significance of respecting the rights and boundaries of all individuals involved in the footballing community. As the case remains open to further legal proceedings, it represents a compelling example of how sports organizations are working to preserve their integrity and uphold the principles of respect and decency.
